Payment Terms

These Payment Terms explain how payment processing services are made available to business owners referred by Vultana, a subsidiary of Skyrise Concepts, LLC (“Vultana,” “we,” “us,” or “our”), and supplement our general Terms of Use.

1. Vultana’s Role

Vultana is an Agent Partner of Payarc. Vultana does not itself process payments, hold merchant accounts, or act as a payment facilitator or independent sales organization. All payment processing services referenced on this Site — including card processing, terminals, online payment acceptance, invoicing, and recurring billing — are provided solely by Payarc LLC, a registered ISO/SP of Chesapeake Bank, Kilmarnock, VA; Evolve Bank & Trust, Memphis, TN; Pinnacle Bank, a Tennessee bank, dba Synovus Bank, Columbus, GA; and a registered payment facilitator of Pathward Bank.

2. Payarc’s Terms Govern Payment Processing

If you choose to use Payarc’s payment processing services, your use of those services is governed exclusively by Payarc’s own merchant agreement and Terms and Conditions, available at payarc.com/terms-and-conditions. You will be asked to separately review and agree to Payarc’s Terms and Conditions before your payment processing account is activated. In the event of any conflict between this page and Payarc’s Terms and Conditions, Payarc’s Terms and Conditions control with respect to the payment processing services themselves.

3. No Guarantee of Approval or Pricing

Introduction to Payarc through Vultana does not guarantee approval for a merchant account, specific pricing, specific hardware or software, or any particular processing rate. Approval, underwriting, pricing, funding schedules, reserve requirements, and account terms are determined solely by Payarc and its sponsor banks in their discretion.

4. Fees, Chargebacks, and Compliance

All processing fees, equipment costs, chargeback liability, reserve requirements, and compliance obligations (including PCI-DSS compliance) applicable to your merchant account are set out in and governed by Payarc’s merchant agreement, not by Vultana. You are responsible for reviewing and complying with those obligations directly with Payarc.

5. Compensation Disclosure

As an Agent Partner, Vultana may receive referral compensation from Payarc based on accounts we refer, including a share of ongoing processing revenue. This does not increase the fees charged to you, but you should be aware Vultana has a financial relationship with Payarc.

6. Limitation of Vultana’s Liability

Because payment processing services are provided by Payarc and not by Vultana, VULTANA IS NOT RESPONSIBLE FOR, AND DISCLAIMS ALL LIABILITY RELATED TO, THE FUNCTIONALITY, SECURITY, AVAILABILITY, PRICING, FUNDING, OR PERFORMANCE OF THE PAYARC PLATFORM, ANY DATA BREACH OR SECURITY INCIDENT INVOLVING PAYARC OR ITS SPONSOR BANKS, OR ANY DISPUTE BETWEEN YOU AND PAYARC. Any such issues should be directed to Payarc under the terms of your merchant agreement with Payarc.
